TERMS OF SERVICE

Please read these Terms of Service carefully before using the Playwe mobile application and website. These Terms constitute a legally binding agreement between you and Playwe.

1. AGREEMENT TO TERMS

Welcome to Playwe. By using our website (http://www.playwe.app), mobile app, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service. In these Terms, "we," "us," and "our" refer to Darmateq, as well as our parent company, affiliates, and subsidiaries. If you do not agree to all of these terms, you are expressly prohibited from using our Services.

2. ELIGIBILITY AND REGISTRATION

The Services are intended for users who are at least 18 years of age. By registering for an account, you represent and warrant that you are at least 18 years old. We do not knowingly permit individuals under 18 to use our Services. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate.

3. USER ACCOUNTS AND SECURITY

You are responsible for safeguarding your account credentials and for any activities or actions under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. We reserve the right to remove, reclaim, or change a username if we determine it is inappropriate or offensive.

4. THE SERVICES (TECHNOLOGY PLATFORM ONLY)

Playwe provides a technology platform that enables users to discover and connect with local sports partners, join sports activities, or create their own events. Playwe is a technology provider and does not organize, supervise, instruct, or control any of the sports activities listed on the Services. While we facilitate these connections, we do not employ the users, nor are we responsible for the conduct of any user, whether online or offline. Users interact with one another at their own risk.

5. ASSUMPTION OF RISK AND LIABILITY WAIVER

A. Assumption of Risk: You acknowledge that participating in sports and physical activities involves inherent risks, including but not limited to, physical injury, disability, and death. You voluntarily assume all risks associated with any activities you join or organize through our Services. You agree that Playwe does not verify the health conditions, skill levels, or physical fitness of any user.

B. Waiver of Liability: To the maximum extent permitted by law, you hereby release, waive, and forever discharge Playwe, its officers, and employees from any and all claims, demands, or causes of action resulting from your participation in activities facilitated by the Services, including claims arising from the negligence of other users or third-party venue providers.

C. Personal Responsibility: You are solely responsible for ensuring you are physically fit to participate in a sport and for maintaining your own insurance coverage.

6. COMMUNITY GUIDELINES

To maintain a safe, trusted, and transparent environment for all participants, you agree to abide by the following Community Guidelines when engaging with the Services:

  • Respect and Safety: You must interact with other users with respect. Harassment, bullying, or threatening behavior toward any participant in a sports activity is strictly prohibited.
  • Accuracy: To enable trust, you must provide accurate profile information, including your birth date, gender, and skill levels.
  • Commitment: Users are expected to act in good faith. If you join an activity, you should follow through or communicate changes to other participants to maintain community reliability.
  • Content Standards: You may not post or share content that is illegal, offensive, sexually explicit, or promotes unauthorized commercial solicitation.

Failure to comply with these guidelines may result in the immediate suspension or permanent deletion of your account.

7. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make the Services available. Prohibited activity includes, but is not limited to: harassing, annoying, or threatening any other user; using the Services for any illegal or unauthorized purpose; uploading harmful material; attempting to impersonate another user; engaging in automated system use; or interfering with, disrupting, or creating an undue burden on the Services or the networks connected to the Services.

8. USER-GENERATED CONTENT

You may be able to create, post, or share content. You retain all rights to your content, but you grant Playwe a non-exclusive, royalty-free, worldwide license to use, display, and distribute said content in connection with the operation of the Services.

9. PRIVACY AND COOKIES

Your use of the Services is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference. Please review our Privacy Policy at http://www.playwe.app to understand our practices regarding your personal data.

10. ACCOUNT DELETION AND TERMINATION

You may terminate your account at any time through the App settings or by emailing delete@playwe.app. We process deletion requests within 30 days. We reserve the right to terminate or suspend your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.

11. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, PLAYWE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICES OR INTERACTIONS WITH OTHER USERS.

12. GOVERNING LAW

These Terms shall be governed by and defined following the laws of Sweden. You and Playwe both consent that the courts of Sweden shall have exclusive jurisdiction to resolve any dispute which may arise under these Terms.

13. MODIFICATIONS TO TERMS

We may modify these Terms at any time. We will notify you of any material changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
